BUZZBAY PTY LTD – TERMS AND CONDITIONS OF USE
www.buzzbay.energy is a website (Site) operated by BuzzBay Pty Ltd ACN 667 067 816 (BuzzBay, we, us and
our).
These Terms and Conditions (Terms) govern your use of this Site, BuzzBay electronic vehicle chargers (BuzzBay
Chargers), BuzzBay mobile application (including the in-app browser) (BuzzBay App), and any other features,
apps, technologies, software, or services offered by us (Services).
We may amend these Terms and the Site from time to time to reflect changes to our products, our users’ needs,
changes in law and our business priorities. Every time you wish to use our Site or our Services, please check
these Terms to ensure you understand the terms that apply at that time.

1 ACCEPTANCE OF TERMS
You agree to be bound by these Terms when you:
(a) access and use this Site;
(b) register an account with us;
(c) interact with a charger within our Services; or
(d) use our Services for any purpose, including to charge your electric vehicle (EV).
2 USING OUR SITE
Our Site is directed to users who are at least 16 years old and are residing in and using this Site within
Australia. We do not represent that content available on or through our Site is appropriate for use or
available in other locations. If you access our Site from outside Australia, you do at your risk and you are
responsible for compliance with laws applicable to your accessing of the Site from your location.
3 REGISTERING AN ACCOUNT
3.1 We may require you to register an account with us to access parts of this Site and to access and use our
Services.
3.2 If you register an account with us, your registration details must be treated as confidential. You must not
disclose it to any third party.
3.3 By registering an account with us, you warrant and agree that:
(a) you are at least 16 years of age;
(b) you will only use our Services in accordance with these Terms and all applicable laws;
(c) you will not use our Services for any illegal or unauthorised use;
(d) you have authority, power, and capacity to register and control any EVs whose vehicle identification
numbers (VIN) are associated with your account (if any); and
(e) you will notify BuzzBay as soon as reasonable in the event that you are no longer authorised to
register or control the EV whose VIN is associated with your account (if any).
3.4 If you know or suspect that anyone other than you knows your user identification code or password, you
must promptly notify us at [support@buzzbay.energy].
4 BUZZBAY HOSTS
4.1 BuzzBay Hosts are solely responsible for their own chargers and any associated equipment, as well as for
any damage, misuse, or other issues arising from the use of their parking areas or related infrastructure.
BuzzBay is not liable for any such damage, misuse, or other poor conduct associated with your electric
vehicle charger, plug outlet, or the use of your parking space.
4.2 Registration of a charger is the host’s acceptance of responsibility over that charger.
4.3 Any charger registered under the BuzzBay app or network—whether owned by a Host or by BuzzBay
directly is the responsibility of the respective owner of that hardware and property. Agreements made by
BuzzBay with sites that install BuzzBay hardware are specific to the terms provided to the site at the time of
the agreement and do not impose liability on BuzzBay.
5 PAYMENTS
5.1 The charges and fees for the use of our Services are set by BuzzBay, can be found on the BuzzBay
Website, and are subject to change at any time at BuzzBay’s sole discretion.
5.2 You agree to pay any applicable fees and charges for using our Services by registering your credit card or
debit card details with BuzzBay via the Site, the BuzzBay App, or via any method approved by BuzzBay
from time to time.
5.3 By registering a credit card or debit card on the BuzzBay App or third party provider, you:
(a) warrant that the details registered with BuzzBay or third party provider are accurate and that you are
authorised to use the relevant payment method;
(b) authorise BuzzBay to charge the fees (including pre-authorisations) and any other amounts payable
under the Terms and the applicable Membership Terms to that payment method; and
(c) agree to take no steps to reverse, vary, or otherwise interfere with the charges.
5.4 You agree to promptly review and update your payment method details with BuzzBay as necessary.
5.5 Your payments are non-refundable except as expressly provided in these Terms, the applicable
Membership Terms, or as otherwise agreed to by you and us.
6 YOUR OBLIGATIONS
6.1 You may use the Site and our Services only for lawful purposes and in accordance with these Terms, and
any other terms agreed between you and us from time to time.
6.2 You agree not to use the Site and our Services:
(a) in violation of these Terms, any applicable laws or for an unauthorised purpose;
(b) in connection with a commercial or business purpose, unless specifically approved by us;
(c) to impersonate or attempt to impersonate us, any of our employees, another user or any other
person or entity (including, without limitation, by using email addresses associated with any of the
foregoing); or
(d) to engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Site or our
Services, or which, as determined by us, may harm us or users of the Site or our Services or expose
them to liability;
6.3 You agree not to:
(a) use any automatic or manual process to reverse engineer, decompile, data-mine, scrape, dissemble
or otherwise deal with the Site or our Services in any way other than as it is intended to be used;
(b) attempt to gain unauthorised access to, interfere with, disable, overburden, impair, damage or disrupt
any parts of the Site; or
(c) otherwise attempt to interfere with the proper working of the Site or our Services.
6.4 When using a BuzzBay Charger, you warrant and agree that:
(a) you will exercise all reasonable care for your health and safety;
(b) you will comply with all relevant instructions for use as set out by us on the BuzzBay Charger or
BuzzBay App;
(c) the EV being charged has a current certificate of roadworthiness and is registered for use in
Australia; and
(d) the EV being charged does not present any danger or risk to any other persons or vehicles or the
BuzzBay Charger.
6.5 We may report any of the activities above to the relevant law enforcement authorities and we will cooperate
with those authorities by disclosing your identity to them. In the event of such a breach, your right to use
our Site and our Services will cease immediately.
7 INTELLECTUAL PROPERTY
7.1 We are the owner or the licensee of all intellectual property rights in our Site, the material published on our
Site, and our Services (as applicable). Those works are protected by copyright laws, intellectual property
laws and treaties around the world. All such rights are reserved.
7.2 Any data that is provided by you, whether directly or indirectly, through your use of the Site and our
Services, will vest in and be owned by BuzzBay. To the extent that such data contains personally
identifiable information, such data will be handled in accordance with our Privacy Policy.
7.3 You must not use any part of the content on our Site for commercial purposes without obtaining a licence to
do so from us or our licensors.
7.4 If we provide social media features such as the ability to share content, you may take such actions as are
enabled by such features.
7.5 You must not delete or alter any copyright, trademark, or other proprietary rights notices from copies of
materials from this Site.
8 WE ARE NOT RESPONSIBLE FOR WEBSITES WE LINK TO
8.1 Where our Site contains links to other sites (including banner advertisements and sponsored links) and
resources provided by third parties, these links are provided for your information only. Such links should not
be interpreted as approval by us of those linked websites or information you may obtain from them. We
have no control over the contents of those sites or resources, and you access third party websites entirely
at your own risk and subject to the terms and conditions of use for those websites.
9 LIMITATION OF LIABILITY
9.1 This Site and our Services are provided on an “as is” and “as available” basis for use at your own risk, and
we make no representations or warranties, express or implied, regarding the operation or availability of the
Site and our Services.
9.2 Although we make reasonable efforts to update the information on our Site, we make no representations,
warranties or guarantees, whether express or implied, that the content on our Site is accurate, complete or
up-to-date.
9.3 In no event will we, our affiliates or their licensors, service providers, employees, agents, officers, or
directors be liable for damages of any kind to you or your EV, under any legal theory, arising out of or in
connection with your use, or inability to use:
(a) the Site, any websites linked to it, any content on our Site or such other websites or any services or
items obtained through our Site or such other websites; or
(b) our Services, including due to the BuzzBay Chargers being inaccessible, unavailable, or
incompatible with your EV or systems,
including any direct, indirect, special, incidental, consequential or punitive damages, including but not
limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of
business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort
(including negligence), breach of contract or otherwise, even if foreseeable.
9.4 Nothing in this these Terms affects any liability which cannot be excluded or limited under applicable law.
We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes
liability for death or personal injury caused by our negligence or the negligence of our employees, agents,
or subcontractors and for fraud or fraudulent misrepresentation. Where our liability cannot be excluded, we
limit our liability to the fullest extent permitted by the Australian Consumer Law.
9.5 You agree to defend, indemnify and hold us, our affiliates, licensors and service providers, and each of their
respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns,
harmless from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or
fees (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use
of the Site or our Services.
9.6 Subject to this clause 9 , to the maximum extent permitted by law, you agree that the maximum aggregate
liability of BuzzBay for all proven losses, damages, and claims arising out of or in connection with these
Terms or a supply under these Terms, is limited to $100.00.
9.7 Different limitations and exclusions of liability will apply to liability arising as a result of the supply of any
products to you on a commercial basis, which will be set out in our Service Agreement.
10 WE ARE NOT RESPONSIBLE FOR VIRUSES
10.1 We do not guarantee that our Site will be secure or free from bugs or viruses or any other type of malicious
code or software.
10.2 You are responsible for configuring your technology to access our Site. You should use your own antivirus
software.
11 RULES ABOUT LINKING TO OUR SITE
11.1 You may link to our home page, provided you do so in a way that is fair and legal and does not damage our
reputation or take advantage of it and provided you have received our express consent to do so.
11.2 Our Site must not be framed or mirrored on any other Site, nor may you create a link to any part of our Site
other than the home page.
11.3 We reserve the right to withdraw linking permission without notice.

12 OUR TRADE MARKS ARE REGISTERED
12.1 BuzzBay and all related names, logos, product and service names, designs and slogans are our trade
marks or the trade marks of our affiliates or licensors. You must not use such marks without our prior
written permission unless they are part of material you are using as permitted under clause 11 . Other
names, logos, product and service names, designs and slogans on this Site are the trade marks of their
respective owners and are used by us under licence.
13 TERMINATIONS
13.1 We do not guarantee that our Site or our Services, or any content on them, will always be available,
uninterrupted or be error-free. We may suspend or withdraw or restrict the availability of all or any part of
our Site or our Services for business and operational reasons. We will try to give you reasonable notice of
any suspension or withdrawal.
13.2 Clause 9 will survive termination of these Terms.
13.3 Termination of use of Site
You may terminate your use of the Site at any time by ceasing further use of the Site. BuzzBay may
terminate your use of the Site as a website visitor at BuzzBay’s sole discretion for any reason or no reason,
including for violation of these Terms.
13.4 Termination of account
(a) BuzzBay may terminate or suspend your account and membership immediately and restrict or
remove your access to our Services if:
(i) you have not paid or BuzzBay is not otherwise able to recover, any fees or payments owing
on your account;
(ii) you have breached, or BuzzBay reasonably suspects that you have breached, these Terms
or the Membership Terms;
(iii) you have, in BuzzBay’s reasonable view, used the Site or our Services in a way that creates
legal risk for BuzzBay or presents a threat to the security of our Services or BuzzBay’s users;
or
(iv) BuzzBay is required to do so by law.
(b) You may terminate your account with BuzzBay at any time by providing BuzzBay with written notice.
14 GOVERNING LAW
The laws applicable in Victoria, Australia govern these Terms. You and we both submit to the non-exclusive
jurisdiction of the courts of Victoria, Australia or the courts of the Commonwealth of Australia sitting in
Melbourne.
15 OTHER TERMS AND CONDITIONS
Additional terms and conditions may also apply to specific portions, services or features of the Site. All such
additional terms and conditions are incorporated by this reference into these Terms.
